高校英語の不定詞についてです。

画像の⑴のの問題で、答えが
Tom seems to have been studying in the library all day.（和訳:トムは一日中図書館で勉強しているようだ）
となっているのですが、なぜto have been studyingでhaveになるのですか？
学校では、to have been doingは完了進行形と習ったのですが、、。
現在形なのでto be stdyingではダメなのですか？
